Terms & Conditions

These Terms & Conditions (“Terms”) govern all bookings, events, and performances by Daksh The Band (“Band”) and form a legally binding agreement between the Client/Event Organizer (“Client”) and the Band. By confirming a booking, the Client acknowledges that they have read, understood, and agreed to these Terms.

1. Booking & Payment Terms

1.1 Advance Payment

  • A minimum of 50% advance of the total agreed amount is required at the time of booking to confirm the date.
  • The remaining 50% balance must be paid at least three (3) days before the event date.

1.2 Full Payment Deadline

The complete payment as per the Proforma Invoice must be made at least two (2) days before the event.

1.3 Payment Clearance

If full payment is not cleared before the event, the Band reserves the right not to perform, and no refund shall be provided.

1.4 Payment Methods: Transactions & Billing

All payments must be made strictly through:

  • Bank Account Transfer (details provided upon confirmation)
  • Razorpay
  • CcAvenue

No cash or unlisted payment methods are accepted.

Payment Transaction & Medium

After making any payment, the Client must share:

  • Transaction ID
  • Screenshot of payment medium
  • Date/time of payment

Booking is considered confirmed only after verification.

2. Cancellations & Rescheduling

2.1 Cancellations by Client

  • All payments made are non-refundable.
  • Amount can be adjusted within 90 days, subject to availability.
  • No refund for natural disaster cancellations.

2.2 Cancellations by Band

In rare cases of Band-initiated cancellation, the full amount will be refunded or the event rescheduled, based on mutual agreement.

3. Performance Terms

3.1 Performance Duration

  • Standard duration: 90 minutes
  • Maximum: 120 minutes (2 hours)
  • 1–2 extra songs may be performed at Band’s discretion.

3.2 Performance Responsibility

The Band is not liable for any accidents, damages, or mishaps during the event. The Client is responsible for a safe environment.

3.3 Technical & Safety Requirements

Client must ensure proper stage, sound system, and lighting as per Band specifications.

4. Hospitality & Event Requirements

  • 2 private rooms with refreshments for 5–6 hours.
  • 25–30 sealed water bottles on stage.
  • Post-event dinner (vegetarian preferred).

5. Outstation & International Events

Flights & Travel

  • International: 7–8 flight tickets (1 Business Class, others Economy)
  • Domestic: Similar arrangement
  • Meals & beverages included
  • Road travel if destination within 200 km

Accommodation

  • Minimum 5-star hotel/resort
  • 3 double rooms + 1 suite room

Local Transfers

  • Two 6–7 seater AC cars (Innova Crysta/XUV 700 preferred)

Security

  • 2 bouncers near stage
  • 4 bouncers with team for security

6. Force Majeure

Neither party is liable for failure due to events beyond control such as natural disasters, restrictions, strikes, or technical failures.

7. Governing Law & Dispute Resolution

This Agreement is governed by Indian law. Disputes fall under Delhi or Uttar Pradesh jurisdiction as per Band/company decision.

8. Invoicing, Billing & Corporate Processing

All financial processing is done via True Knock Events (a brand of True Knock Group). All bookings and payments must go through this entity.

9. Liability

The Band may change Terms anytime without prior notice. Bookings only valid from individuals above 18 years of age. If a minor books mistakenly, the Band is not liable for any payments, changes, or refunds.

10. Acceptance of Terms

By making a booking, the Client confirms they have read and agreed to these Terms & Conditions in full.
